Terms and Conditions

1. Introduction

Welcome to Qonnect.me. These Terms and Conditions govern the use of our services, which provide digital business cards, QR codes, chatbot interactions, and lead capture functionalities. By accessing or using our services, you agree to these terms. Please read them carefully.

By signing up for a Qonnect.me Subscription, you and any entity that you represent ("Customer") are unconditionally consenting to be bound by and are becoming a party to these Qonnect.me Subscription Terms ("Agreement") as of the date of Customer's first payment for the services (the "effective date"). Customer's continued use of the software or any licensed materials provided by Qonnect.me (or one of its affiliates and/or subsidiaries, as specified on an order form or quote) shall also constitute assent to the terms of this agreement. If these terms are considered an offer, acceptance is expressly limited to these terms. If you are executing this agreement on behalf of an organisation, you represent that you have authority to do so.

2. Service Plans

Qonnect.me offers three distinct plans designed to cater to varying business needs:

Standard Plan:

Features:

  • Custom Chatbots/Surveys: 2, each with a unique QR code for easy access.
  • Sales Representatives: Directs all interactions to a single sales representative.
  • Active Chats: Up to 20 active chats per day per chatbot.
  • Lead Management: No data logging; while lead details are accessible to the sales representative during the chat interaction, they will need to manually transfer this information to their CRM or preferred communication channel after the conversation ends.

Ideal For: Businesses seeking a straightforward solution to guide user interactions to one representative without retaining lead data in the system. This allows sales reps to have access to lead information in real-time, but they are responsible for recording it externally.

Premium Plan:

Features:

  • Custom Chatbots/Surveys: 5, each with a unique QR code for easy access.
  • Sales Representatives: Can route interactions to up to 5 different sales representatives.
  • Active Chats: Up to 50 active chats per day per chatbot.
  • Lead Management: Logs lead-related data (e.g., contact information, responses) for exporting to your CRM system. Customers will have the ability to extract the necessary information about end users and export it in a CSV file, facilitating easy uploads to their CRM of choice. No full conversation logs are stored.

Ideal For: Businesses that require more complex interactions, allowing multiple representatives to manage leads while retaining essential lead data for follow-up. This plan is ideal for those looking to efficiently capture and manage customer information without the burden of extensive data retention.

Custom Plan:

Features:

  • Custom Chatbots/Surveys: Number of chatbots/surveys is flexible and subject to discussion and agreement, each with a unique QR code.
  • Sales Representatives: Configurable based on business needs and discussions.
  • Active Chats: Customizable based on requirements.
  • Lead Management: Logs and stores full chatbot conversations for management purposes and allows for export to CRM. Customers may also request extended data retention periods for an additional fee, subject to agreement on an Order Form.

Ideal For: Businesses needing tailored solutions for managing interactions with specific requirements for data retention, analysis, and routing to multiple representatives.

3. Data Privacy and Storage

3.1. Standard Plan

No Data Logging: In the Standard Plan, Qonnect.me does not store any conversations or lead data. Once the chatbot interaction is complete, the data is used solely for real-time processing and is not retained by Qonnect.me.

3.2. Premium Plan

Lead Data Logging: Under the Premium Plan, Qonnect.me will log lead-related data such as names, email addresses, and other form responses collected through the chatbot. This data is stored temporarily for the sole purpose of exporting it to your CRM.

No Full Conversation Storage: Only lead data is retained for CRM export; the full text of chatbot conversations is not stored.

3.3. Custom Plan

Full Conversation Storage: In the Custom Plan, Qonnect.me will log and store all conversations between the chatbot and users. This data will be accessible for the account's administrative users for management and analytical purposes.

CRM Export: Lead-related data and full conversations are both available for export to your CRM, providing enhanced control and visibility into customer interactions.

Qonnect.me will act as a data processor and will process personal data only as instructed by the customer, in accordance with applicable data protection regulations (e.g., GDPR).

4. General Payment Terms

Before you pay any fees, you will have an opportunity to review and accept the fees that you will be charged. Unless otherwise specifically provided for in these Terms, all fees are in EUR and are non-refundable, except as required by law. The pricing and payment terms in this Section 4 are subject to any pricing and payment terms set forth in an Order Form.

4.1. Price

Qonnect.me reserves the right to determine pricing for the Service. Qonnect.me will make reasonable efforts to keep pricing information published on the Service up to date. We encourage you to check our pricing page periodically for current pricing information. Qonnect.me may change the fees for any feature of the Service, including additional fees or charges, if Qonnect.me gives you advance notice of changes before they apply through the Service user interface, a pop-up notice, email, or through other reasonable means. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount.

4.2. Payment Processing

Notwithstanding any amounts owed to Qonnect.me hereunder, QONNECT.ME DOES NOT DIRECTLY PROCESS PAYMENT FOR ANY SERVICES. To facilitate payment for the Service via bank account, credit card, or debit card, we use Stripe, Inc. and its affiliates (“Stripe”), a third-party payment processor. These payment processing services are provided by Stripe and are subject to the Stripe terms and conditions and other policies available at https://stripe.com/legal and Stripe’s Global Privacy Policy available at: https://stripe.com/privacy (collectively, the "Stripe Agreements"). By agreeing to these Terms, users that use the payment functions of the Service also agree to be bound by the Stripe Agreements, as the same may be modified by Stripe from time to time. You hereby authorise Stripe to store and continue billing your specified payment method even after such payment method has expired, to avoid interruptions in payment for your use of the Service. Please contact Stripe for more information. Qonnect.me assumes no liability or responsibility for any payments you make through the Service.

4.3. Subscription Service

The Service may include certain subscription-based plans with automatically recurring payments for periodic charges (“Subscription Service”). The “Subscription Billing Date” is the date when you purchase your first subscription to the Service. The Subscription Service will begin on the Subscription Billing Date and continue for the subscription period that you select on your account (such period, the “Initial Subscription Period”), and will automatically renew for successive periods of the same duration as the Initial Subscription Period (the Initial Subscription Period and each such renewal period, each a “Subscription Period”) unless you cancel the Subscription Service or we terminate it. If you activate a Subscription Service, then you authorise Qonnect.me or its third-party payment processors to periodically charge, on a going-forward basis and until cancellation of the Subscription Service, all accrued sums on or before the payment due date. For information on the “Subscription Fee”, please see our pricing page. Your account will be charged automatically on the Subscription Billing Date and thereafter on the renewal date of your Subscription Service for all applicable fees and taxes for the next Subscription Period. You must cancel your Subscription Service before it renews in order to avoid billing of the next periodic Subscription Fee to your account. Qonnect.me or its third-party payment processor will bill the periodic Subscription Fee to the payment method associated with your account or that you otherwise provide to us. You may cancel the Subscription Service by using the cancellation functionality made available in your billing menu or by contacting us at info@qonnect.me

YOUR CANCELLATION MUST BE RECEIVED BEFORE THE RENEWAL DATE IN ORDER TO AVOID CHARGE FOR THE NEXT SUBSCRIPTION PERIOD.

4.4. Delinquent Accounts

Qonnect.me may suspend or terminate access to the Service, including fee-based portions of the Service, for any account for which any amount is due but unpaid. In addition to the amount due for the Service, a delinquent account will be charged with fees or charges that are incidental to any chargeback or collection of any unpaid amount, including collection fees. If your payment method is no longer valid at the time a renewal Subscription Fee is due, then Qonnect.me reserves the right to delete your account and any information associated with your account without any liability to you.

4.5. Taxes

Our fees do not include any taxes, levies, duties, or similar governmental assessments of any nature, including, for example, value-added, sales, GST, use or withholding taxes, assessable by any jurisdiction whatsoever in relation to your purchases under this Agreement (collectively, the “Taxes”). You are solely responsible for paying all Taxes associated with your purchases hereunder. If we have a legal obligation to pay or collect Taxes for which you are responsible under this Clause 4.5, we shall invoice you, and you shall pay that amount to us unless you provide us with a valid tax exemption certificate authorised by the appropriate taxing authority. We shall calculate applicable Taxes based on your billing address as detailed on the relevant Order Form or Quote (it is your duty to inform us if Taxes should be assessed on a different address). You shall promptly notify us of any changes to any of your addresses specified in an Order Form or Quote. Taxes shall not be deducted from or set off against the fees in the applicable Order Form or Quote.

5. Data Ownership

All data collected through Qonnect.me, including lead-related data and conversation logs (where applicable), remains your property. We do not claim ownership of any information captured by our system. You can request access or deletion of data at any time, according to your plan’s features.

6. Data Security

We are committed to ensuring that your data is secure. To prevent unauthorised access or disclosure, we have implemented appropriate physical, electronic, and managerial procedures to safeguard the information we collect and store.

All data, including lead-related data and conversation logs, is encrypted using AES 256-bit encryption, both at rest and in transit. Our platform operates over secure HTTPS connections, ensuring that data transfer is protected.

7. User Responsibilities

You are responsible for maintaining the confidentiality of your account login credentials. If you believe your account has been compromised, notify us immediately.

8. Data Retention

Standard Plan:

No data is retained once interactions are completed.

Premium Plan:

Lead data is stored temporarily.

Custom Plan:

Full conversations and lead data will be stored for as long as you have an active subscription or until you request deletion. Customers on the Custom Plan may request extended data retention periods beyond standard limits for an additional fee, subject to agreement on an Order Form.

Upon cancellation:

Standard Plan:

No data will be stored or need deletion, as none is logged.

Premium Plan:

Any lead data will be deleted from our system within 30 days.

Custom Plan:

All stored conversations and lead data will be deleted within 30 days, unless you request earlier removal.

9. Modifications to the Terms

We reserve the right to modify these Terms and Conditions at any time. Significant changes will be communicated to you via email or within our platform.

10. Limitation of Liability

Qonnect.me is not liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our services, including but not limited to loss of revenue, profits, or data. Our total liability will not exceed the amount paid for the service during the preceding 12 months. Qonnect.me will not be held liable for delays or failures in performance due to events beyond our control, including but not limited to natural disasters, government actions, cyber-attacks, or network failures.

11. Acceptable Use Policy

Users agree not to use the Service for unlawful purposes, including but not limited to spamming, harassment, or fraud. Any violation of this policy may result in account suspension or termination.
